1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and MindFast ("Company", "we", "us", or "our"), concerning your access to and use of the MindFast website and mobile application (collectively, the "Services").

You agree that by accessing the Services, you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Services and you must discontinue use immediately.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms, and you waive any right to receive specific notice of each such change.

2. Use of the Services

MindFast is a privacy-focused intermittent fasting app designed to help users build healthy, sustainable fasting habits. The Services are intended only for users who are 18 years of age or older. By using the Services, you represent and warrant that you are at least 18 years old.

3. Health Disclaimer

The Services are intended for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or before starting any diet program, including intermittent fasting.

MindFast does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned within the Services. Reliance on any information provided by MindFast, MindFast employees, or others appearing on the Services at the invitation of MindFast, or other visitors to the Services is solely at your own risk.

Intermittent fasting may not be suitable for everyone. We specifically advise against fasting for individuals who are:

  • Pregnant or nursing
  • Under 18 years of age
  • Have a history of eating disorders
  • Have diabetes or blood sugar regulation issues (unless specifically approved by your physician)
  • Have other serious medical conditions
  • Are taking prescription medications that need to be taken with food

4. Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which is incorporated herein by reference. Our Privacy Policy outlines how we collect, use, and safeguard your information when you use our Services. By using the Services, you consent to the collection and use of information in accordance with our Privacy Policy.

MindFast is committed to protecting your privacy. The app is designed to store all your data locally on your device without requiring account creation, and we do not collect, store, or share your personal information with third parties except as outlined in our Privacy Policy.

5. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by MindFast, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are permitted to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your Web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

6. User Contributions

The Services may contain message boards, chat rooms, personal profiles, forums, bulletin boards, and other interactive features that allow users to post, submit, publish, display, or transmit to other users or other persons content or materials on or through the Services ("User Contributions").

All User Contributions must comply with the Content Standards set out in these Terms. Any User Contribution you post will be considered non-confidential and non-proprietary. By providing any User Contribution, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material.

7. Prohibited Uses

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate MindFast, a MindFast employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm MindFast or users of the Services, or expose them to liability.

8. Subscription and Payment Terms

Some features of the Services may be subject to fees and/or require a subscription. By subscribing to these features, you agree to pay the fees associated with the subscription plan you choose.

Subscriptions will automatically renew at the end of the subscription period unless canceled at least 24 hours before the end of the current period. You can cancel anytime through your device's app store account settings.

Refunds are processed in accordance with the app store policies (Apple App Store or Google Play Store) from which you purchased the subscription. MindFast does not process refunds directly.

9. Apple App Store Additional Terms

If you download the MindFast app from the Apple App Store, these Terms are an agreement between you and MindFast, not with Apple. Apple has no obligation to furnish any maintenance and support services with respect to the MindFast app.

In the event of any failure of the MindFast app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app.

Apple is not responsible for addressing any claims by you or any third party relating to the MindFast app or your possession and/or use of the MindFast app, including: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.

10. Limitation of Liability

IN NO EVENT WILL MindFast, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

11. Indemnification

You agree to defend, indemnify, and hold harmless MindFast, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

12. Termination

We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users of the Services, to us, or to third parties, or for any other reason.

13. Governing Law and Jurisdiction

These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

14. Waiver and Severability

No waiver by MindFast of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of MindFast to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

15. Entire Agreement

These Terms, our Privacy Policy, and any other agreements expressly incorporated by reference herein constitute the sole and entire agreement between you and MindFast regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
